Public Notice of No Significant Environmental Impact and Request for Release of Funds:
On or about September 1, 2025, the Town of Shelburn will request the release federal funds from the Indiana Office of Community and Rural Affairs (OCRA) for Community Development Block Grant Funds (CDBG) from the State of Indiana under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383) for the following project: Comprehensive Utilities Plan - The project involves creating a single comprehensive coordinated plan addressing all three utility systems: water, wastewater, and stormwater infrastructure. planning, infrastructure evaluations, and the development of actionable improvement plans. Finding of No Significant Impact: It has been determined that a request for release of project funds will not constitute any action that significantly affects the quality of the human environment and, accordingly, the Town of Shelburn has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (P.L. 91-190); for the following reasons: Project activities consist of planning and infrastructure evaluations. These activities are exempt under 24 CFR §58.34(a) but remain subject to §58.6. This project has been reviewed, and it has been determined that project activities meet the exemption criteria and will not endanger the environment in any way. The Town has completed an Environmental Review Record (ERR) for the project, documenting the environmental review and explaining why such a statement is not required. This ERR is on file at the Shelburn Utilities Office, 15 N Railroad St, Shelburn, IN 47879, and is available for public inspection and copying upon request between 8:00 A.M. and 4:00 P.M., Monday through Friday. The ERR can also be reviewed electronically or by U.S. mail by sending a request to Kristine Krueger at 2800 Poplar St., Suite 9A, Terre Haute, IN 47803, or via email at [email protected]. No further environmental review of this project is planned before the request for release of funds. Public Comments on Findings: All interested parties and persons concerned with this decision are invited to submit written comments for consideration by the Town of Shelburn to Kristine Krueger at 2800 Poplar St., Suite 9A, Terre Haute, IN 47803 or by email to [email protected]. Such written comments should be received by August 12, 2025. All comments received will be considered, and the Town of Shelburn will not request the release of federal funds prior to the date specified in the preceding sentences. Release of Funds: The Town will undertake the project described above with CDBG Grant funds from the State of Indiana under Title I of the Housing and Community Development Act of 1974. The Town of Shelburn is certifying to the State that the Town and Aaron Lewis, in his official capacity as Council President, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Town of Shelburn may use the Block Grant funds, and the State will have satisfied its responsibilities under the National Environmental Policy Act of 1969. Objections to State Release of Funds: The State will accept an objection to its approval only if it is on one of the following basis: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by the State; or (b) that the applicant's environmental review record for the project indicated omission of a required review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be submitted to Grant Services & OCRA through the ER Report in GMS. The state will not consider objections to the release of funds on grounds other than those stated above. No objections received after August 30, 2025, will be considered by the State.
